Virginia’s 2024 amendment makes anyone who deals in real estate contracts, including assignable contracts, on two or more occasions in any rolling 12-month period for compensation a real estate broker. One assignment a year needs no license; the second does.

What it means for a double close

A double close is a principal transaction, not dealing in contracts. You take title in the first leg and sell your own property in the second, which the owner exemption in § 54.1-2103(A)(1) covers. Virginia wholesalers doing volume use double closes for exactly this reason.

How closings work in Virginia

Title or escrow company closings

Closings here are typically handled by a title or escrow company. We wire directly to the title company’s escrow account, and both legs of the double close must close at that same company.

Virginia closings are mostly handled by title and settlement companies, with attorneys common in some areas. Both legs must settle with the same settlement agent.
