Maryland requires two written disclosures on residential wholesale deals. Before the seller signs, the buyer must disclose in writing that the contract may be assigned. The end buyer must be told in writing that the wholesaler holds only an equitable interest and may not be able to convey title. If either disclosure is missing, the other party can rescind before closing and recover their deposit.

What it means for a double close

Both disclosures are about assignments and equitable interests. In a double close you never assign the contract and your end buyer purchases from you as the recorded owner, so the end-buyer disclosure does not arise. If your A-to-B contract keeps an assignment clause, give the seller disclosure anyway. It costs nothing and removes the rescission risk.
